JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2019 This is an application for grant of anticipatory bail in connection with Excise Case No. 346 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

As per F.I.R. there is recovery of 04 liters of liquor from the shop of the petitioner.

Submission of the learned counsel for the petitioner is that he was not present at the shop, as he has gone out for treatment and as such, he cannot be responsible for the recovery of said liquor.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the

Patna High Court CR. MISC. No.82475 of 2019(2) dt.12-12-2019 2/2 petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court and if, possible to be disposed of on the same day.
