This application for regular bail arises out of Shambhuganj P.S. Case No. 265 of 2018, disclosing the offence under Sections 25(1-b) a, a/35 of the Arms Act. There are two persons named in the FIR. The petitioner is son of co-accused Fulchand Yadav. Allegedly, on a secret information that the accused persons were indulging in illegal manufacture of fire-arms, a raid was conducted whereafter certain articles were recovered, which could be used for manufacture of fire-arms.

Learned counsel appearing on behalf of the petitioner has submitted that there is no difference between accusation against this petitioner and his father Fulchand Yadav, who is

Patna High Court CR. MISC. No.78528 of 2019(2) dt.10-01-2020 2/2 also a co-accused. Fulchand Yadav has been allowed regular bail by this Court by order dated 13.09.2019, passed in Cr. Misc. No. 57178 of 2019.

I find substance in submission made on behalf of the petitioner that the allegation against this petitioner and that against co-accused Fulchand Yadav is similar/ identical. Considering the aforesaid facts and circumstances, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Banka in Shambhuganj P.S. Case No. 265 of 2018.

This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
