2. The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 325, 504 and 506 of the Indian Penal Code registered in connection with Belhar P.S. Case No. 183 of 2018 and subsequently Section 302 of the IPC was added.
3. It is submitted that the petitioners have been falsely implicated as evident from the injury report dated 07.07.2018 (Annexure-3), according to which injuries were found only on the hands and legs. The petitioners claim clean antecedents.
4. Learned APP assisted by learned counsel for the informant has opposed the bail petition. It is submitted that ante mortem injuries were sustained on the chest as evident from post mortem report. Moreover, as evident from paragraph 45 of the case diary, the statement of the deceased was recorded in Belhar Hospital and video-recording also made by the concerned Police Officer in which FIR named accused along with three accused persons were named. It further transpires from paragraph 72 of the case diary that
Patna High Court Cr.Misc. No.67479 of 2018(3) dt.07-01-2019 2/2 processes under Sections 82 and 83 of the Code of Criminal Procedure have also been issued against the petitioners.
5. Having regard to the nature of accusations and gravity of offence alleged, this Court is not inclined to grant anticipatory bail to the petitioners. The anticipatory bail petition stands dismissed. (Vikash Jain, J) BT/Chandran U T
