2. In this case, the petitioner is seeking regular bail in connection with Khizersarai P.S. Case No. 138 of 2008 registered for the offences punishable under Sections 366(A) and 376 of the Indian Penal Code.
3. It is a case of prolonged misuse of privilege of bail. Vide order dated 29.07.2024 passed in Cr. Misc. No. 25539 of 2024, it was observed that the petitioner may renew his prayer for bail after examination of four witnesses.
4. Learned Counsel for the petitioner submits that uptill now five witnesses have been examined.
5. On the other hand, learned Additional Public
Patna High Court CR. MISC. No.86760 of 2024(2) dt.18-02-2025 2/2 Prosecutor for the State opposed the prayer for bail of the petitioner.
6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Gaya in connection with S.Tr. No. 393 of 2009 arising out of Khizersarai P.S. Case No. 138 of 2008, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
7. The petitioner shall remain physically present on each and every date as directed by the Court below and on his absence on two consecutive dates without sufficient reason, his bail bonds shall be cancelled by the Court below. (Nawneet Kumar Pandey, J) Neha/- U T
