JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 06-10-2018 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 448, 379, 354, 323, 307 and 427 of the Indian Penal Code.

The prosecution case as per the written report of Dayashankar Pandey submitted to the Station House Officer, Bagengola P.S., is to the effect that on 24.06.2018, all accused persons 30-35 in number came and snatched the chain from the wife of the informant, started pelting stones and robbing articles. They also took out Rs.1,35,000/- from the box. It is alleged that

Patna High Court Cr.Misc. No.61977 of 2018 (2) dt.06-10-2018 2/3 the accused persons assaulted the brothers of the informant, Dayashankar Pandey, Gupteshwar Pandey and Ranjeet Pandey and other persons were identified in the mob including the petitioners.

It is submitted by learned counsel for the petitioners that for a dispute with regard to taking bath in a pond, the petitioners' side lodged Bagengola P.S. Case No. 38 of 2018 against the informant's side. The accusation is omnibus and general and a statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.

Learned APP submits that the accusation is specific against the petitioners.

Considering the accusation against the mob, genesis of the occurrence when it is submitted that the injuries of the three injured persons have found to be simple in nature and coaccused person Sanjay Ram has been granted bail vide order dated 12.09.2018 passed in Cr. Misc. No. 53840 of 2018 by a coordinate Bench of this Court, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten
