The petitioner seeks bail in G.O. Case No. 786/2018, instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that total 69.450 litres of country made foreign liquor has been recovered from the Scooty of this petitioner.

Learned counsel for the petitioner has submitted that petitioner is in custody since 10.09.2018.

Learned counsel for State has submitted that petitioner is accused in other excise case also.

Considering the period of custody of the petitioner,

Patna High Court Cr.Misc. No.62103 of 2018 (2) dt.10-10-2018 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge IVth-cum-Special Judge, Darbhanga in connection with G.O. Case No. 786/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.

The petitioner will file affidavit at the time of release that he would not indulge himself in such type of activity in future. In the event, he is found indulging in such type of activity, his bail bond will liable to be cancelled.
