The petitioner seeks bail in connection with Gopalpur P.S. Case No.171 of 2019 registered under Sections 272, 273 and 420 of the Indian Penal Code besides Sections 30(a), 35 and 38 of the Bihar Prohibition and Excise Act, 2016. The accusation is of recovery of 38.400 liters country made liquor from the motorcycle, which was being driven by this petitioner.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and is in custody since 19.09.2019.

Having regard to the facts and the circumstances of

No.77376 of 2019(2) dt.28-11-2019 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Gopalganj, in connection with Gopalpur P.S. Case No.171 of 2019.
