1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners apprehend their arrest in connection with Bhairav Asthan P.S. Case no.01 of 2024 registered under sections 302, 120B, 328 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that accused persons had invited her husband for a party and had given food. It is further alleged that accused persons reached at the house of informant along with her husband who was found in an unconscious condition and ultimately done to death. The informant raised suspicion that all accused gave poison to her

4. Learned counsel for the petitioners submits that it would be clear from the F.I.R itself that it was an admitted fact that the deceased had gone on invitation for food and hence, relations between the parties were not bad and moreover, the petitioners had sent an information to the informant to call her husband back but no one came from her house and thus, the petitioners had brought the deceased to the house of the informant. Further, postmortem report of the deceased does not show any external injury on the body of the deceased and F.S.L report also indicates no volatile poison was detected in his body. The petitioners undertake to co-operate in case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. In view of the aforesaid facts and circumstances of the case, it is directed that the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bhairav Asthan P.S. Case no.01 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is
