JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 The petitioner seeks anticipatory bail in connection with Puraini P.S. Case No. 171 of 2019, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is of recovery of 1862 litres of liquor from a pick up van and driver of the pick up van disclosed that the same belongs to petitioner and one co-accused and it further appears that petitioner is an accused in one more case of similar nature.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case on confessional statement of driver of the pick up van and except that there is nothing against the petitioner and although he is accused in one more case but he is on bail in that case.

Patna High Court CR. MISC. No.80929 of 2019(2) dt.10-12-2019 2/2 Learned counsel for the State opposed the prayer for anticipatory bail on the ground that petitioner has criminal antecedent as he is accused in one more case of similar nature. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather this application is disposed of with direction to the petitioner to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
