A Tata 407, Santro Car were seized alongwith apprehension of three persons, who disclosed their identity as Surendra Kumar, Brajesh Kumar, Narendra Kumar on account of recovery of 15 gallon, each containing 35 litres of spirit. It is evident from the written report that the name of the petitioner is not at all found and in likewise manner, the statement of the witnesses so recorded. It is further evident that during inculpatory confessional statement of one of the co-accused Narendra Kumar, the name of the petitioner including others is found exposed as his associate.

In the aforesaid facts and circumstances of the case, let the petitioner Lato Chaudhary, in the event of his arrest or
