JUSTICE SANJAY PRIYA ORAL ORDER 10-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Katra P.S. Case No. 189 of 2018 instituted for the offence under Sections 272, 273, 413 of the Indian Penal Code, Sections 30(a), 36 and 38 of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that total 9.3 liters of foreign liquor has been recovered from possession of the petitioner. Petitioner is said to be in custody since 3.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.62340 of 2018 (2) dt.10-10-2018 2/2 amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Katra P.S. Case No. 189 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.

Counsel for the State submits that petitioner was earlier also involved in Excise case. In view of such, the petitioner will file an affidavit at the time of his release that he will not indulge in such type of activity in future and if he is found indulging in such activity, his bail bond will liable to be cancelled.
