2. In the present case, the petitioner seeks bail in connection with Kurtha P.S. Case No. 215 of 2024, registered for the offences under Sections 115(2), 117(2), 109, 303(2), 352, 3(5) of BNS, 2023.
3. As per prosecution case, petitioner and other coaccused persons, armed with lathi and iron rod, assaulted the husband of the informant, causing injuries to him. Family members of the informant were also assaulted.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Admittedly there is land dispute and both the parties are agnates. The husband of the informant was medically examined
Patna High Court CR. MISC. No.89067 of 2024(2) dt.08-01-2025 2/3 and only one lacerated wound of size 2.5" x 1.6" was found on the right parietal region of scalp. There is allegation of assault on the head of the husband of the informant by iron rod against this petitioner and co-accused Mithlesh Yadav but only one injury has been found on the head and as such entire prosecution story becomes suspicious. Petitioner is accused in two cases in which he is on bail. Petitioner is in custody since 17.10.2024 and charge-sheet has been submitted.
5. Learned APP opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the single injury received by the victim and also considering the period of custody of the petitioner coupled with submission of charge-sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Arwal/concerned court, in connection with Kurtha P.S. Case No. 215 of 2024, subject to the condition laid down under Section 437(3) of the code of Criminal Procedure and other following conditions: (i) One of the bailors will be a close

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
