2. The petitioner has prayed for bail in connection with Muzaffarpur Cyber P.S. Case No. 79 of 2025 registered for the offence punishable under Sections 3(5), 111(2), 316(2), 318(4), 319(2) and 337 of the B.N.S. and Sections 66B, C, D & E of the Information Technology Act.

The case of the prosecution is that on secret information, the informant reached the residential hotel, Aryan Residency, at room no. 305 and found that three boys were quarreling with each other for money. On interrogation, they disclosed their names as petitioner and others. It is further alleged that co-accused Abhishek Pandey disclosed that they

No.87075 of 2025(3) dt.18-02-2026 2/3 were staying here from 31st July, 2025 and there is a bank account in Axis Bank in the name of NGO Ram Pyari Nand Lal Sewa Sansthan and in the bank account by way of cyber fraud, Rs. 8,33,00,000/- (eight crore thirty-three lakhs) has been received. There is a dispute between Vikram Kumar and him for the commission of money received in the account. Mahavir Kumar @ Sonu and Guddu Kumar used to prepare Aadhar cards by committing fraud, and they used to help him in cyber fraud. On search, passbooks, mobiles, PAN cards, Aadhar cards, debit cards, rubber stamps, etc. have been recovered.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has further been submitted that from perusal of the seizure list, it is clear that from the possession of this petitioner two mobiles were recovered. All the documents of the NGO were recovered from the possession of the co-accused, namely, Abhishek Pandey. It is only the statement of the co-accused that they were having a dispute over the commission of the fraud amount. No incriminating material has been recovered from the possession of this petitioner. He is having no criminal antecedent and he is languishing in judicial custody since
Patna High Court CR. MISC. No.87075 of 2025(3) dt.18-02-2026 3/3 07.08.2025. It has also been submitted that similarly situated coaccused, namely, Vikram Kumar Singh has been granted bail by this Court vide Cr. Misc. No. 83989 of 2025. The case of this petitioner stands on similar footing.
5. The application for bail is vehemently opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur East in connection with Muzaffarpur Cyber P.S. Case No. 79 of 2025.
