JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-09-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Delha P.S. Case No. 204 of 2019, registered under Sections 341, 342, 504, 506, 354(B), 305(D), 116 and 503 of the Indian Penal Code, pending in the court of the learned A.C.J.M.VII, Gaya.

The accusation is that informant came in touch of petitioner, who was living in her mohalla, before three years, the petitioner assured to perform marriage with her. In the meantime, he also managed to take her personal photograph without her knowledge, but before two years, the petitioner performed his marriage to other girl then informant made request to petitioner to delete her photograph, but petitioner

Patna High Court CR. MISC. No.77032 of 2019(4) dt.25-09-2020 2/3 was not ready for the same and on the basis of her photographs, the petitioner used to blackmail her for developing physical relation. On 18.07.2019, while the informant was going to attend coaching, at that time, petitioner came near her and, forcibly, boarded her in the Alto vehicle and thereafter, she was taken in the hotel, where petitioner started to give pressure for physical relation. When informant made protest then she was assaulted and threatened to throw acid in case of refusing his proposal.

Learned counsel appearing on behalf of petitioner submits that, in fact, petitioner and informant live in same mohalla and informant wanted to perform marriage with the petitioner, but the family members of petitioner was not ready for the same due to that reasons, the present false case has been lodged. Further submission is that after lodging the present case, the informant filed compromise petition in the Court of learned A.C.J.M.VII, Gaya on 13.08.2019. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, his prayer for grant of pre-arrest bail stands rejected.
