2. The petitioner seeks bail in connection with Beldour P.S. case No. 265 of 2023, G.R. No. 3326 of 2023 instituted for the offences under Sections 341, 323, 504, 506, 384, 386, 347, 379/34 of the Indian Penal Code.
3. Prosecution case, in short, is that the two coaccused persons assaulted the informant and looted silver bracelet (worth Rs. 12,000), but both the accused persons were apprehended by the police. The apprehended person disclosed the name of other co-accused persons, including the name of this petitioner.
4. It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.09.2023 and has no criminal

The petitioner has falsely been implicated in the present case only on the basis of confessional statement of the co-accused, namely, Raja Kumar. No specific overt act is alleged against the petitioner. No incriminating material has been recovered from the possession or from the house of the petitioner rather the looted article (silver bracelet) was recovered from the possession of the co-accused, namely, Raja Kumar.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Beldour P.S. case No. 265 of 2023, G.R. No. 3326 of 2023.
