2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 394 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution is that two unknown miscreants have snatched the bag of the informant containing cash of Rs. 50,000/-. It is also alleged that one of the miscreants has fired at him due to which, he has received gun shot injury.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation, one Sumit has given his confessional statement and he has named this

Nothing has been recovered from the possession of this petitioner. Save and except the confessional statement of co-accused, there is nothing is against him. Similarly situated other co-accused person has already been granted bail by this Court vide order dated 03.12.2025 passed in Cr. Misc. No. 81063 of 2025. The case of this petitioner stands on similar footing. Moreover, he is languishing in judicial custody since 16.06.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of eight cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rail Barahiya P.S. Case No. 04 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul( Lakhisarai) with the following conditions:- (i) the petitioner shall cooperate in trial and shall be physically present before the trial court whenever required.
