JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 The petitioner seeks regular bail in connection with Mahendia P.S. Case No. 46 of 2019, registered for offences punishable under Sections 392/411 of the Indian Penal Code. Prosecution case is that while the informant was going with Bolero pick up van loaded with plywood, some miscreants came from Bolero and intercepted his Bolero pick up van and taken away his Bolero pick up van as well as his mobile phone. F.I.R. was lodged against unknown. Later on petitioner was arrested as the mobile of the informant was being used by him. It further appears that he is accused in one more case. It has been submitted on behalf of the petitioner is that the pick up van and the articles were recovered just after one day and he has falsely been implicated in this case and has has been in judicial custody since 02.08.2019 and chargesheet has

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Mahendia P.S. Case No. 46 of 2019, subject to the condition that petitioner has to appear before the Officer-in-Charge of the police station of his area in the first week of each month for a period of six months so that the police may watch his conduct during that period.
Let a copy of this order be communicated to the Superintendent of Police, Jehanabad also.
