JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(a), 38(i), 56(d) of the Bihar Prohibition and Excise Act 2016.

Taking into consideration that the alleged recovery of illicit liquor has been made from the house of the petitioner. I am not inclined to extent privilege of anticipatory bail to the petitioner and, accordingly, his prayer for bail in connection with Ramgarh P.S.Case No. 214 of 2018, pending in the court of learned Special Judge Excise, Kaimur at Bhabhua stands rejected.

However, if petitioner surrender before the court

Patna High Court Cr.Misc. No.67516 of 2018(2) dt.06-12-2018 2/2 below within four weeks from today and seeks regular bail his prayer for regular bail shall be considered by the concerned court on its own merit keeping in mind that the petitioner was not arrest at the spot.
