2. The petitioner seeks bail in a case registered for the offence punishable under sections 376/354B/34 of the Indian Penal Code.

3. As per the prosecution case, when informant was undergoing Ultrasound check up at Sai Ultrasound, Nawanagar, Buxar, the operator committed indecent act by touching her private parts and when she called her husband, said operator fled away. Persons present on the spot told the informant that it was the petitioner who committed said offence.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on suspicion. Till date, no Test

Patna High Court CR. MISC. No.564 of 2024(4) dt.10-04-2024 2/2 Identification Parade has been conducted. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 9.10.2023.

Considering the fact that there is vague identification of the petitioner and no TIP has been conducted in the case and petitioner is in custody since 9.10.2023, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Nawanagar Police Station Case No. 349 of 2023.
