JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-08-2024 The present writ petition has been filed seeking the following reliefs:- " (i) For issuance of writ of mandamus and/or such other writs, order or orders directing and commanding the Respondents No. 1,2,3 and 4 to submit the report of investigation carried by them upon the receipt of the

Patna High Court CWJC No.890 of 2024(3) dt.22-08-2024 2/3 complaint of the Petitioner against the Respondent No. 10.

(ii) For issuance of writ of mandamus to register a case of disproportionate assets under the Prevention of Corruption Act and such other acts as is applicable in the facts and circumstances of the case, in view of the complaint filed by the Petitioner before Respondent No. 2, 3 and 4, against Respondent No. 10.

(iii) For issuance of writ of mandamus directing Respondents especially Respondents No.3 and 4, to protect the possession of the Petitioner against the forced dispossession by Respondent No. 10 and his agents."

At the outset, the learned counsel for the petitioner submits that the respondents no. 3 has filed a counter affidavit in the present case, wherein in paragraph no.6, it has been stated that yet another committee has been constituted afresh, vide memo dated 13.06.2024 to enquire into the complaint made by the petitioner and it shall submit it's inquiry report whereafter, appropriate decision shall be taken with regard to the further course of action. In such view of the matter, the learned counsel for the petitioner submits that sometime be fixed for the said committee to furnish the inquiry report.

3. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct that the aforesaid committee shall furnish its report, within a period of six months

Patna High Court CWJC No.890 of 2024(3) dt.22-08-2024 3/3 from today, whereupon appropriate action shall be taken in accordance with law.

4. Accordingly, the writ petition stands disposed off on the aforesaid terms.
