====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-02-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Jhajha P.S. Case No.01 of 2017 registered under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that regarding the theft of cash, mobile etc. from the house of the informant, the present case was lodged by the informant against 3-4 unknown. It would appear from the impugned order dated 03.08.2018 passed in A.B.P. No.805 of 2018 by the Sessions Judge, Jamui, whereby the prayer of the petitioner to extend the privilege of pre-arrest bail was rejected, that the name of the petitioner in this case has

Patna High Court Cr.Misc. No.63621 of 2018(3) dt.01-02-2019 2/2 come in the confessional statement of the co-accused Ajay Kumar Yadav, who is none else but is accused in Complaint Case No.772C of 2016, which is pending in the court of the Chief Judicial Magistrate, Jamui, lodged by Baleshwar Yadav, in which the name of the petitioner has been shown as a witness, which would appear from Annexure-2 to this application. The petitioner has no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Jamui, in connection with Jhajha P.S. Case No.01 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
