JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 10-12-2019 The petitioner, who, himself was an applicant for grant of PDS license has challenged the selection of private respondent no. 4 who has been selected for grant of such license.

The reasons for the aforesaid challenge is that private respondent no. 4 has been accommodated in a wrong quota and for other reasons also her selection is stated to be bad.

Patna High Court CWJC No.24589 of 2019 dt.10-12-2019 2/2 These are the issues which could be thrashed out in appeal before the appellate authority under Rule 32 of the Bihar Targeted P.D.S. (Control) Order, 2016. Since the provision for appeal is available and which provision has not been availed of by the petitioner, I do not wish to entertain the present petition. Should the petitioner prefer an appeal before the appellate authority within a period of three weeks, the same shall be disposed of by a reasoned order within a period of sixty days of the receipt of such representation. With the aforesaid direction/observation, the writ petition stands disposed of.
