This application for anticipatory bail arises out of Complaint Case No. 1140(C) of 2011 for the offence punishable under Sections 498(A), 323, 406 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.

Petitioner is the husband of the complainantopposite party No.2. There is allegation in the complaint petition of demand of dowry. The petitioner was granted interim protection vide order dated 07.01.2020, while issuing notice to the opposite party No.2.

Considering the nature of accusation and the submission made on behalf of the petitioner that it is

Patna High Court CR. MISC. No.83202 of 2019(7) dt.08-02-2021 2/2 matrimonial discord, which is the reason behind lodging of the complaint petition, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bettiah, West Champaran, in Complaint Case No. 1104(C) of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
