JUSTICE BIRENDRA KUMAR ORAL ORDER 20-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is languishing in custody for the offence punishable under Sections 302, 328, 307 and 120B of the Indian Penal Code.

The F.I.R. of the occurrence of murder is against Md. Shakil and three unknown.

Submission is that the trial is still pending. There is no direct evidence against the petitioner. Petitioner is a female. She has got no criminal antecedent and is in custody since 12.12.2014.

Considering the entire facts, especially the fact that petitioner is a female having no direct allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty

Patna High Court CR. MISC. No.81328 of 2019(2) dt.20-03-2020 2/2 thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bisfi (Patauna) P.S. Case No. 271 of 2014, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
