2. The petitioner is in custody since 08.07.2023 in connection with Motipur P.S. Case No. 346 of 2016 registered for the offence punishable under Sections 323/341/324/307/ 379/504/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have assaulted the victim with knife.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. Learned counsel for the petitioner further submits that no strong motive has been assigned by the informant in the F.I.R. for the alleged incident.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.1799 of 2024(2) dt.18-01-2024 2/2 behalf of the State has vehemently opposed the prayer for bail. He further submits that the injury report supports the allegations against the petitioner.

6. Considering the facts and circumstances of the case and also the medical evidence, this application for grant of bail is dismissed.

7. The trial court is directed to expedite the trial. If the trial is delayed because of the laches of the prosecution, the petitioner may renew his prayer for bail.
