JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-01-2026 Heard learned counsel appearing on behalf of the petitioners, learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 140(1), 89, 61(2) and 3(5) of the B.N.S..

3. The prosecution case, in brief, is that the widowed sister of informant was deceived into a relationship by co-

It is alleged that with the help of all other F.I.R. named accused persons, including these petitioners, co-accused Rajesh Yadav forced abortion of sister of informant and later on, refused to solemnize marriage. It is further alleged that on 06.06.2025, coaccused Rajesh Yadav took away sister of informant from the house after which, she went missing.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. From bare perusal of the F.I.R. it is apparent that specific accusation of kidnapping is against coaccused Rajesh Yadav. No specific role has been attributed against these petitioners. Petitioners claim clean antecedents.

5. On the other hand, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that petitioners are named in the F.I.R. with specific accusation that they helped co-accused Rajesh Yadav in kidnapping the victim, who is still traceless.

6. Considering the facts and circumstances of the case, specific and direct nature of accusation, gravity of offence and the fact that the victim is still traceless, the prayer for grant
