JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 The petitioner seeks bail in connection with Nalanda P.S.Case No. 87 of 2018 registered under Sections 120B,399 and 402 of the Indian penal Code and 25(1-b),a,26 and 35 of the Arms Act.
Allegation, as per the FIR, is that the informant after receiving secret information that some miscreants have assembled for committing an offence, raided the house of the petitioner. Petitioner was arrested and ten live cartridges were recovered from his pocket and from his house one rifle without bolt and 12 live cartridges and two empty cartridges were recovered.
Submission of learned counsel for the petitioner is that report of the sergeant major disclosed that the rifle was not in
Patna High Court Cr.Misc. No.66511 of 2018(4) dt.06-12-2018 2/2 working condition moreover, petitioner has remained in custody for about six months and he has no criminal antecedent. Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda at Biharsharif in connection with Nalanda P.S. Case No. 87 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
