The petitioner seeks regular bail in connection with Manjhi P.S.Case No.336 of 2019 registered for offences punishable under Sections 30, 30 (a), 38(i)(ii) of the Bihar Prohibition and Excise Act, 2016 .
Allegation against the petitioner is about recovery of 1425 ltrs. of liquor from the tanker. So far this petitioner is concerned, it is said that he is a liner and following the truck by the Alto Car .
Submission of the learned counsel for the petitioner is that four persons were named as the liner sitting in the Alto Car and they have been granted bail by a Co-ordinate Bench of this Court vide order dated 13.12.2019 passed in Cr. Misc.
Patna High Court CR. MISC. No.78109 of 2019(2) dt.13-01-2020 2/2 No.82822/19 and order dated 20.12.2019 passed in Cr Misc. No.84952 of 2019 . He has no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides and in view of submissions as made above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge cum Special Judge, Excise , Saran in connection with Manjhi P.S.Case No.336 of 2019. With the aforesaid observation, this application is allowed.
