2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 303(2), 109, 352, 351(2) and 3(5) of the BNS.
3. The informant alleges that on account of dispute relating to passage, three named accused persons, including the petitioner, came and assaulted him causing injury on his head, thereafter Vikash and Subhash assaulted the wife of the informant by lathi causing injury. Co accused Niraj and Khusboo assaulted Mahesh, the brother of the informant by rod causing injury on his head and lips. Further, Manoj Devi and Rakesh assaulted Surendra by rod causing injury on his head and above his right eye. Further, Subhash assaulted Mutur Devi
Patna High Court CR. MISC. No.84376 of 2025(2) dt.23-12-2025 2/3 by rod causing injury on her head. Further, Jai Prakash Yadav and the petitioner assaulted Ranju Devi and threatened and snatched Mangalsutra of the wife of the informant and Vikash also threatened with gun.

Learned Advocate for the petitioner submits that besides the omnibus nature of accusation against the petitioner, it is the admitted position that the occurrence took place on account of a dispute relating to passage, wherein both the parties entered into a free fight resulting into injuries to persons of both the sides. Taking note of the aforesaid facts, co-accused person, namely, Jai Prakash Yadav @ Jaipraka Yadav, who is facing identical allegation, has been allowed the privilege of anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 76554 of 2025 vide order dated 01.12.2025. It is also submitted that though the petitioner has antecedent of one case, however he is on bail in the said case.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the nature of accusation, coupled with the fact that the case of the petitioner stands on identical footing with that who has been

No.84376 of 2025(2) dt.23-12-2025 3/3 accorded the privilege of anticipatory bail by a coordinate Bench of this Court, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Paraiya P.S. Case No. 178 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
