JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 19-12-2019 The petitioner has challenged the order dated 23.07.2019 passed by the Executive Engineer, Minor Irrigation Department, Samastipur whereby, for the petitioner not having completed the allotted work in time, the agreement with him has been cancelled and the surety amount has been forfeited.

The learned counsel for the petitioner submits that approximately 70% of the work has been done and

These are the issues of facts which may not engage the attention of this Court.

However, should the petitioner make a grievance against the aforesaid order before the superior authority or any higher authority under the contract, his grievance shall be looked into and reasonable order shall be passed. Beyond this, this Court is not inclined to interfere with the decision of the Executive Engineer, Minor Irrigation Department.

With the aforesaid direction/observation, the writ petition stands disposed of.
