JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-02-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Excise Case No. 624 of 2019 registered for the offences punishable under Sections 30(a), 41(i) of Bihar Prohibition and Excise Amendment Act, 2018.

Since the present case has been lodged for the offences of Bihar Prohibition and Excise Act, in view of Section 76(2) of above stated Act, this anticipatory bail petition is not maintainable and accordingly, this anticipatory bail petition stands dismissed being not maintainable.

However, this order shall not cause any prejudice to concerned court while considering the regular bail application of

Patna High Court CR. MISC. No.86959 of 2019(2) dt.14-02-2020 2/2 the petitioner, if petitioner surrenders before the court below within six weeks from today.
