2. The petitioner has preferred this application for grant of regular bail in connection with Patna Cyber P.S. Case No. 1456 of 2024 dated 31.08.2024 registered for the offence/s punishable u/ss 318(4), 319(2), 111(1)(3)(4), 61(2) of the BNS.

3. As per the prosecution case, the petitioner and the co-accused persons used to cheat the people on the pretext of providing loan and job after giving advertisement on social media. On being searched, several mobile phones, cheque book, ATM cards and sim cards were recovered from the possession of the petitioner and the co-accused persons.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.87406 of 2024(2) dt.17-02-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. It is further submitted that no one has made any complaint against the petitioner regarding the cheating. The petitioner has two criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 01.09.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Patna Cyber P.S. Case No. 1456 of 2024, with the following condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled. (ii). If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to
