2. The petitioner seeks regular bail in connection with Suguali P.S. Case No. 511 of 2022 registered on 29.11.2022 lodged under Sections 30(a) and 41(i) of Bihar Prohibition and Excise Amendment Act, 2018.
3. As per the prosecution case, total recovery of 80 litre of illicit liquor has been the subject matter of this case.
4. Counsel for the petitioner submits that the alleged recovery has not been made from his possession which is apparent from the seizure list.
5. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner
Patna High Court CR. MISC. No.5001 of 2024(2) dt.07-02-2024 2/2 is in custody since 25.09.2023 having three criminal case pending against him.
6. Learned counsel for the State opposes the prayer for bail.
7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail after framing of charge and on being satisfied that petitioner is not absconding in any of the cases pending against him which is mentioned herein below and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise, Judge Court. 1, Civil Court, East Champaran, Motihari in connection with Suguali P.S. Case No. 511 of 2022.
