The petitioner seeks bail in a case registered under Sections 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application with an observation 'at this stage'. In pursuance of the said observation, the present application has been filed on behalf of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.11.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge has already been framed. The injury is on
Patna High Court CR. MISC. No.80468 of 2019(2) dt.17-01-2020 2/2 non-vital part of the body. There is no chance of trial being concluded in near future. Other co-accused has been granted bail vide Cr.Misc.No.77264 of 2019.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II, Lakhisarai in connection with Sessions Trial No.157 of 2019 arising out of Halsi P.S. case No.163 of 2018.
