Petitioner seeks bail in Puraini P.S. Case No.118 of 2019 registered under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the IPC and under Sections 25(1-b)a, 26 and 27 of the Arms Act.

The gist of the allegation is that a panchayati was called and on the order of Sahendra Singh, the petitioner is alleged to have fired causing injury to Pappu @ Abdul Sattar. Learned counsel for the petitioner submits that the petitioner was apprehended on the spot and arms were recovered. The petitioner is in jail since 14.06.2019. The petitioner has got no criminal antecedent.

From perusal of the injury reports, it appears that of

Patna High Court CR. MISC. No.77942 of 2019(3) dt.19-03-2020 2/2 course the injuries were alleged to have been caused by firearm but the injuries are simple in nature. The opinion with regard to the nature of injury was reserved but the final opinion was not obtained till the submission of charge sheet. The petitioner has remained in jail for more than eight months.

Having considered the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Uda Kishunganj, Madhepura in connection with Puraini P.S. Case No.118 of 2019.
