The petitioner, who is custody since 14.07.2019, seeks bail in connection with Barauni P. S. Case No. 297 of 2019 dated 14.07.2019 instituted for the offences under Sections 25(1-B), 26(II) and 35 of the Arms Act, 1959.

A vehicle which was being driven by the petitioner was intercepted from which a bag was recovered containing four country-made pistols. Some of the occupants of the vehicle, who too have been made

Patna High Court CR. MISC. No.80642 of 2019(2) dt.16-12-2019 2/2 accused in this case, have been granted bail in this case. In the earlier cases in which the petitioner has been made accused and about which reference has been made in paragraph 3 of the petition, he is on bail. Apart from this, it has been submitted that the petitioner did not have any idea that the occupants of the vehicle had carried the aforesaid firearms. Regard being had to the period of custody of the petitioner and there being no recovery from his personal possession, the petition is allowed. The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Barauni P. S. Case No. 297 of 2019.
