2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 385, 386, 504 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution is that the petitioner has fired at the cheek of the driver of the informant namely, Ravindra Kumar.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. During course of investigation, the injured Ravindra Kumar has given his statement before police and he has stated that Guddu Rai and others fired at him. He has not specifically stated whether this petitioner has made any fire at him or not. From perusal of the medical report, it transpires that the injured of this case has
Patna High Court CR. MISC. No.87297 of 2024(4) dt.04-04-2025 2/2 received fire arm injury on right side of face. The nature of allegation is general and omnibus. Similarly situated other coaccused namely, Saroj Ray @ Saroj Rai has been granted bail by this Court in Cr. Misc. No. 73631 of 2024. Moreover, the petitioner is languishing in judicial custody since 10.06.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail and submits that the petitioner is having criminal antecedent of seventeen cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with a condition that the petitioner shall be present on each and every day during the trial. The above named petitioner is directed to be released on bail in connection with Koilwar P.S. Case No. 208 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara.
