The petitioners seek regular bail in connection with Excise Case No. 331 of 2019 for the offence registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
The allegation is regarding recovery of 216 liters of illicit liquor from a Wagon-R car, of which the petitioner no. 1 is said to be the driver and the petitioner no. 2 is said to be his accomplice.
The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present
Patna High Court CR. MISC. No.76439 of 2019(2) dt.04-12-2019 2/2 case and they are having clean antecedents. It is further submitted that the petitioners are languishing in custody since 19.09.2019.
Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Gopalganj in connection with Excise Case No. 331 of 2019.
