The present interlocutory application has been filed to add the prayer in the main writ application i.e. for quashing part of the order as contained in memo no.843 dated 13.04.2024 issued by the respondent no.2 so far as it relates to treat the petitioner as untrained teacher instead of graduate trained teacher and further for commanding the respondents to pay dues

Patna High Court CWJC No.187 of 2024(4) dt.12-02-2025 2/3 of salary as well as retirement benefits to the petitioner in graduate trained pay-scale along with other consequential benefits.

3. Having heard learned counsel for the parties and for the reasons mentioned in this application, I.A. No.1 of 2025 is allowed and the prayer made in this application shall be treated to be part of the main writ application.

4. Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Accountant General.

5. At the very outset, learned counsel for the petitioner submits that the case of this petitioner is squarely covered with the order dated 21.11.2022 passed in C.W.J.C. No.17970 of 2022.

6. Learned counsel for the State does not dispute the aforesaid position.

7. Considering the fact that the case of this petitioner stands on the similar footing to that of petitioner of C.W.J.C. No.17970 of 2022, no useful purpose would be served in keeping this writ application pending. Accordingly, the memo no.843 dated 13.04.2024 issued by the respondent no.2 is

Patna High Court CWJC No.187 of 2024(4) dt.12-02-2025 3/3 hereby set aside and this writ application stands disposed of in terms of the order passed in C.W.J.C. No.17970 of 2022.

8. State is directed to give all consequential benefits to the petitioner in terms of the order passed in C.W.J.C. No.17970 of 2022.
