2. Petitioner seeks regular bail in connection with Adapur P.S. Case No.295 of 2021 registered under Sections, 147, 341, 323, 307, 379, 504, 506 and 34 of the I.P.C.

3. It is alleged that the F.I.R. named accused persons including petitioner holding weapons in their hand stopped the motorcycle of the informant's cousin and took away money from him. The petitioner is alleged to have given iron rod blow on the head of the informant's cousin causing cut injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The informant and the petitioner both are co-villagers. There is a case and counter case between the parties. The F.I.R.

Patna High Court CR. MISC. No.86107 of 2023(2) dt.16-01-2024 2/2 has been lodged after three days of the alleged occurrence without any explanation. The petitioner is 81 years old and he was not present on the spot. Petitioner has two criminal antecedents in which he is on bail. The petitioner is in custody since 11.10.2023.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case as well as the submissions advanced on behalf of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of J.M. 1st, Class, Raxaul, East Champaran in connection with Adapur P.S. Case No.295 of 2021 corresponding to G.R. No.1142 of 2021.
