====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
3. As per the prosecution case, the allegation is that the informant received information about the killing of his elder brother and went to G.M.C.H., Bettiah. It is further alleged that the F.I.R.-named accused, Bablu Alam @ Gurjar, had called the informant from the mobile number of his brother, Govind Kumar. It is also alleged that one Prem Sah had threatened the family members with dire consequences.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.84389 of 2025(2) dt.04-12-2025 2/2 petitioner is not named in the F.I.R. The informant has not raised any suspicion regarding the petitioner's involvement in the F.I.R. During the course of investigation, the name of the petitioner surfaced only in the confessional statement of coaccused Bablu Alam @ Gurjar, who has already been granted bail by this Court vide order dated 24.08.2023 passed in Cr. Misc. No. 54036 of 2023. The petitioner is in custody since 18.09.2025 and charge-sheet has been submitted in this case.
5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of the accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran, in connection with Bettiah (Town) P.S.
