====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners seek bail in a case registered for the offence under Sections 373 / 34 of the Indian Penal Code.
3. As per F.I.R., petitioners are accused of buying and selling minor for unlawful purpose.
4. It is submitted on behalf of petitioners that petitioners are father and son respectively and have been falsely implicated in this case. From bare perusal of F.I.R., it is apparent that there is no allegation against these petitioners that they are involved in sale and purchase of the victims for prostitution. Petitioner no. 2 is a disabled person. Save & except suspicion, there is no material against these petitioners. In this
Patna High Court CR. MISC. No.893 of 2024(3) dt.21-03-2024 2/2 case, chargesheet has already been submitted. Petitioners are in custody since 18.09.2023.
5. However, learned A.P.P. for the State opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Supaul in connection with Jadiya P.S. Case No. 240 of 2023.
