2. Petitioner seeks regular bail in connection with S.T. Case No. 87 of 2023 arising out of Karakat P. S. Case No. 176 of 2022 in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.
3. As per the prosecution case, this petitioner along with other F.I.R. named accused persons committed murder of the daughter, grand-daughter (natin) and grand-son (nati) of the informant.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case only on suspicion. Petitioner is husband of the deceased Archana Raj. He next submits that as a matter of fact, Archana Raj was a
Patna High Court CR. MISC. No.86680 of 2023(3) dt.21-03-2024 2/2 depressed lady and she herself killed both the children and thereafter, committed suicide. He further submits that there is no eye witness of the occurrence. Petitioner is in custody since 25.09.2022.
5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner is none other than husband of the deceased Archana Raj and in this case, three persons have been killed and there is specific accusation that this petitioner along with other accused persons committed murder of his wife and children.
6. Considering the nature of accusation and gravity of the offence, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Navya/- U T
