The petitioner seeks bail in S.T. No. 306/2018, arising out of Saraiya P.S. Case No. 325/2017, instituted for the offences under Sections 302, 120(B) and 34 of the Indian Penal Code.
It is alleged in the written report that on the date of occurrence son of informant was taking tea. In the meantime, this petitioner along with other accused persons arrived on two motorcycles and went near the son of informant. Petitioner is alleged to have caused firearm injury on the head of son of informant. Co-accused Vijay Kumar Singh also fired shot. Thereafter, the informant along with other persons tried to apprehend the accused persons but they fled away on
Patna High Court Cr.Misc. No.64609 of 2018(3) dt.20-11-2018 2/2 motorcycle after making firing. Son of the informant was taken to hospital where he was declared dead.
Post-mortem report is available in case diary, wherein doctor has found one firearm injury on the right temporal region.
Petitioner is main assailant in this case.
In view of such, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, prayer for bail of the petitioner is rejected.
