JUSTICE SANJAY PRIYA ORAL ORDER 6/ 05-02-2019 Pursuant to the order dated 23.01.2019, the Sr. Superintendent of Police, Patna, is personally present in Court. She has stated that she has just joined on 4th January, 2019 as Sr. Superintendent of Police. She submits that after coming to know of the order of this Court, she has immediately taken action and Final Form as required under Section 173 Cr.P.C. has been submitted in the case, after concluding investigation. Detailed statement has been made in para 12 of the show cause. Counsel for the Petitioner has pointed out that earlier order was passed by this Court on 20.12.2017. Admittedly, there has been delay in compliance of the

Patna High Court MJC No.4028 of 2018(6) dt.05-02-2019 2/2 order of this Court as there was definite direction to conclude the investigation within a period of three months from the date of passing of the order.

Since the Officer i.e. Sr. Superintendent of Police, Patna, has joined recently and she was not aware of the direction of this Court, show cause filed by the Sr. Superintendent of Police, Patna, is hereby accepted.

It appears that earlier show cause was filed by the Dy. Superintendent of Police, Town, Patna, in very casual manner without considering the seriousness of the order of this Court. It is expected that Sr. Superintendent of Police, Patna, will take appropriate action for such casual approach of the Officer concerned in taking the order of this Court very casually. Since order of this Court has already been complied with, this application stands disposed off. No further order is required to be passed in the case.

Personal appearance of the Sr. Superintendent of Police, Patna, is dispensed with.
