The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Prosecution case as lodged by the informant is that on 16.03.2019 when he was returning from Madhubani by his motorcycle and on the way at N.H. 57 it was alleged that on a motorcycle on which three persons were riding came near him and told to stop. It is further stated that upon which he stopped his motorcycle thereafter one accused person snatched the key and fled away after taking his motorcycle. It is alleged that other two accused persons had taken his purse and bag. The informant stated that he could not identify the accused persons and

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R., no T.I. parade has been done as yet, and has been falsely implicated in the present case. He submits that the name of the petitioner has come on the confessional statement of co-accused Mukesh Yadav. He further submits that no incriminating article has been recovered from the possession of the petitioner and he is languishing in judicial custody since 13.08.2019.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhubani in connection with Sakri Police Station Case No. 25 of 2016 corresponding to G.R.
