JUSTICE SANDEEP KUMAR ORAL ORDER 01-03-2024 This is the second attempt of the petitioner for grant of regular bail as earlier the application of the petitioner for grant of regular bail has been rejected vide order dated 22.05.2023 passed in Cr. Misc. No. 61208 of 2022.

2. Heard learned counsel for the petitioner and learned APP for the State.

3. The petitioner seeks bail in connection Piro P.S. Case No. 395 of 2022 registered for the offence under Section 392 of the Indian Penal Code.

4. As per the prosecution case, the petitioners and Dinesh Rajwansi were arrested and the amount of Rs. 3,30,000/- was recovered from the possession of Dinesh Rajwanshi.

5. Since there is a recovery of Rs. 3,30,000/-, this Court finds no new ground for grant of bail to the petitioner.

6. Accordingly, this application is dismissed.

7. A report was called from the District Judge, Bhojpur at Ara with regard to the present state of trial of all the cases pending against the petitioner. The report has been received and upon perusal of the same, it appears that the witnesses are not produced by the prosecution side for examination.

8. In these circumstances, the Superintendent of Police, Bhojpur at Ara is directed to produce the witnesses in Piro P.S. Case No. 395 of 2022, Piro P.S. Case No. 399 of 2022 and Piro P.S. Case No. 359 of 2022 regularly so that the trial of the petitioner is concluded at the earliest.

9. Let a copy of this order be communicated to the Superintendent of Police, Bhojpur at Ara through FAX for its compliance.
