The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363 and 365/34 of the Indian Penal Code.

According to FIR, the daughter of the informant was a receptionist in the school where the petitioner was Director. On 07.04.2018, the daughter of the informant did not return then informant gathered that this petitioner had kidnapped her along with others.

Submission of the learned counsel for the petitioner is that the victim has already resigned vide her resignation letter at Annexure-2, which is witnessed by her father also on 12.03.2018 and resignation was accepted on 13.03.2018 itself.

Patna High Court Cr.Misc. No.66161 of 2018(3) dt.09-01-2019 2/2 Moreover, on 18.04.2018, she filed a petition to the Senior Superintendent of Police, Bhagalpur that no one had abducted her and she is residing at the place of her desire to prosecute her further study.

Considering the entire facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Habibpur Police Station Case No. 66 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
