JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In spite of serving of summons, no one appeared on behalf of the opposite party no. 2.
Petitioner is apprehending his arrest in a case registered in connection with Manila P.S.Case No. 18 of 2019 for the offences punishable under Sections 341, 323, 379, 498A of the Indian Penal Code.
The allegation against the petitioner is that he forced the complainant Babita Devi to execute 1 Bigha land from her father in favour of petitioner.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.77030 of 2019(7) dt.07-03-2022 2/2 petitioner is falsely implicated in this case. Petitioner is ready to keep the complainant with full honour and dignity. Learned Additional Public Prosecutor opposed the bail prayer of the petitioner.
Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Araria in connection with Mahila P.S Case No. 18 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U
