The petitioner seeks bail in connection with Buxar (Town) P.S. Case No. 64 of 2019 registered under Sections 147, 148, 149 and 302 of the Indian Penal Code and 27 of the Arms Act.

Submission is that it would appear from the first information report that informant, Madan Yadav, who has claimed to be eye witness of the occurrence has disclosed the names of 11 persons indulged in firing at his son, Amarjeet Yadav, and he has not disclosed the name of the petitioner. In course of investigation, police got recorded the confessional statement of co-accused, Rakesh Yadav, who disclosed the name of the petitioner as his associates, indulged in firing. In fact, petitioner is accused in two cases, as detailed in paragraph 3 of

Patna High Court CR. MISC. No.76929 of 2019(2) dt.18-12-2019 2/2 the bail petition, due to that reason the police implicated the petitioner in the present case showing his name in the confessional statement of the co-accused, Rakesh Yadav and the petitioner is in custody since 16.09.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Buxar (Town) P.S. Case No. 64 of 2019 to the satisfaction of the Chief Judicial Magistrate, Buxar.
